Welcome to Forge Softwares (the parent company of Cobra and Runo). These Terms and Conditions govern the use of our services. By engaging Forge Softwares or any of our subsidiaries for any project, you agree to the terms outlined below.
1. About Forge Softwares
Forge Softwares provides custom digital solutions, including:
- Premium website design and development
- AI-powered automation systems
- AI agents and chatbots
- Custom software tools
- Domain setup assistance
- Hosting support and deployment services
Every project is tailored to the specific requirements of the client.
2. Client Eligibility
Our services are available to:
- Businesses
- Startups
- Organizations
- Individual clients
- Domestic and international customers
We reserve the right to refuse any project that does not align with our policies, capabilities, or legal requirements.
3. Pricing and Payment
Project Initiation
A minimum advance payment of 10% is required before work begins.
Final Payment
The remaining balance must be paid before final project delivery and deployment.
Accepted Payment Methods
- UPI
- J&K Bank Transfer
- PayPal
- Google Pay
- Paytm
Failure to complete payments may result in delayed delivery, suspension of services, or project termination.
4. Refund Policy
Because all projects involve custom development:
- Advance payments are non-refundable.
- No refunds are available once work has started.
- Refund requests made before development begins may be reviewed on a case-by-case basis.
5. Project Delivery
Project timelines are discussed and agreed upon before development begins. A project is considered complete when all agreed features and functionality have been delivered. Final delivery typically includes:
- Live deployment on the client's domain or hosting environment
- Functional website, application, or software solution
Unless specifically included in a written agreement, source code is not part of standard project delivery.
6. Revisions and Changes
We aim to provide a smooth revision process.
Included:
- One reasonable revision per week during active development
Additional Changes:
- Minor changes: starting from ₹500
- Major modifications: quoted separately
Forge Softwares reserves the right to determine whether a requested change is minor or major based on complexity and development effort.
7. Hosting and Technical Support
Forge Softwares may assist with hosting, deployment, and maintenance.
Important notes:
- Hosting support may utilize third-party providers such as GitHub and similar platforms.
- Complimentary hosting may be provided while services remain active.
- Hosting arrangements may be modified, migrated, or discontinued when necessary.
- Domain ownership always remains with the client unless otherwise agreed in writing.
Basic post-delivery support may be provided at our discretion.
8. Client Responsibilities
Clients are responsible for:
- Providing accurate information
- Supplying required content and materials
- Responding to requests within a reasonable timeframe
- Using our services lawfully
Project delays caused by missing information, delayed approvals, or lack of communication may affect delivery timelines.
9. Ownership and Intellectual Property
Client Rights
Upon full payment:
- The client receives the right to use the delivered product for its intended purpose.
- The client retains ownership of their domain name.
Forge Rights
Unless otherwise agreed in writing:
- Source code remains the intellectual property of Forge Softwares.
- Internal systems, frameworks, templates, and proprietary tools remain owned by Forge Softwares.
- Forge Softwares may showcase completed work in its portfolio and marketing materials.
10. Cancellation
Before Development Begins
Cancellation requests may be eligible for partial refunds at our discretion.
After Development Begins
No refunds will be issued once development work has started.
11. AI-Powered Services
Some services may utilize artificial intelligence technologies. While we strive for accuracy:
- AI-generated outputs may occasionally contain errors.
- Clients are responsible for reviewing content before use.
- Forge Softwares will make reasonable efforts to correct identified issues.
Forge Softwares is not responsible for business decisions made solely based on AI-generated output.
12. Suspension or Termination of Services
We may suspend, restrict, or terminate services if:
- Payments remain unpaid
- Services are misused
- Illegal activity is detected
- Terms are violated
Following suspension:
- Websites may be taken offline
- Services may become inaccessible
- Data retention is not guaranteed
13. Limitation of Liability
To the maximum extent permitted by law:
Forge Softwares shall not be liable for:
- Business interruption
- Revenue loss
- Profit loss
- Data loss
- Indirect or consequential damages
Our maximum liability shall not exceed the total amount paid by the client for the specific project giving rise to the claim.
14. Third-Party Services
Projects may rely on third-party services, including:
- Hosting providers
- Domain registrars
- Payment gateways
- AI service providers
Forge Softwares is not responsible for outages, policy changes, restrictions, or failures originating from third-party providers.
15. Privacy and Confidentiality
Client information is treated confidentially and handled with reasonable security measures. We do not sell or share client information except:
- When required by law
- When necessary to deliver contracted services
- With the client's consent
16. Quality Commitment
Forge Softwares is committed to delivering reliable, modern, and professionally developed digital solutions. Every project undergoes testing before delivery to verify:
- Core functionality
- Responsiveness across devices
- Basic performance standards
- Agreed project requirements
No software system can be guaranteed to be entirely free from defects, but we will work in good faith to resolve issues that fall within the agreed project scope.
17. Force Majeure
Forge Softwares is not responsible for delays or service interruptions caused by circumstances beyond our reasonable control, including:
- Internet outages
- Power failures
- Government restrictions
- Natural disasters
- Cyberattacks
- Third-party service failures
18. Governing Law
These Terms and Conditions are governed by the laws of India. Any dispute arising from these terms shall be subject to the exclusive jurisdiction of the courts of Jammu & Kashmir, India.
19. Changes to These Terms
We may update these Terms and Conditions periodically. The latest version will always be available on our website. Continued use of our services after changes are published constitutes acceptance of the revised terms.
